Detectives from the Niagara Regional Police Service Collision Reconstruction Unit have been investigating the fatal July 13, 2023, fail to remain collision that occurred in Niagara on the Lake.
Nestor Chemerika (84 yrs.) was cycling on East West Line near Concession 2 Road when a pewter coloured 1999 GMC Sierra pick up truck struck him and left the scene. Tragically Chemerika died in hospital due to the injuries sustained when he was struck.
On October 3, 2023, Richard Alan Moore (37 yrs.) of Niagara Falls was arrested and charged by detectives. Moore has been charged with the offences of:
Fail to Stop After Accident-Causing Death – Criminal Code Careless Driving Cause Death – Highway Traffic Act
Moore was held in custody for a video bail hearing to the Robert S. K. Welch Courthouse in St. Catharines on October 4, 2023.

At approximately 8:30pm on Thursday July 13, 2023, 2 District (Niagara Falls/Niagara on the Lake) uniform officers were on routine patrol when they discovered an injured elderly male lying in the north side drainage ditch on East West Line at Concession 2.
The 84-year-old male was treated at the scene by paramedics with Niagara Emergency Medical Services (NEMS) before being airlifted to an out-of-town hospital for treatment of life-threatening injuries.
Investigation revealed that the male had been hit by a truck or utility vehicle while cycling and that the vehicle then left the scene prior to police arrival.
This collision remains under investigation by detectives with the Niagara Regional Police Service Collision Reconstruction Unit.
The vehicle involved in this hit and run collision will be missing a passenger side view mirror and will have damage to the passenger side front corner.
Investigators are asking anyone who has information (including dash cam footage) or who may have been in the general area of East West Line at or near the time of the incident, to contact police at (905) 688-4111, dial option 3, ext. 1009089.

The investigation has determined that on Thursday July 13, 2023, at 8:24pm, an 84-year-old male cyclist from Niagara on the Lake was found in critical condition lying in a north side drainage ditch on East West Line near Concession 2 in Niagara on the Lake. The cyclist had been riding a blue mountain bike westbound along the north side of East West Line between Niagara Road and Concession 2 when they were struck from behind. The damaged vehicle fled the scene without providing care to the cyclist or reporting the collision to emergency personnel. The victim was transported to an out of region hospital for treatment of life threatening injuries. The victim remains in hospital in critical condition.
Damaged vehicle parts were recovered at the scene by detectives. The suspect vehicle has been determined to be either a (1994-1999) GMC Yukon, GMC Suburban or a GMC Sierra Pick-up Truck. The suspect vehicle colour will be pewter metallic or silver. The suspect vehicle involved in this hit and run collision will be missing a passenger side view mirror and will have damage to the passenger side front corner.
Detectives are appealing the public for any information that may assist them with this investigation. Autobody repair shops and auto parts dealers are asked to report any inquiries or transactions that may be suspicious or related. Anyone (residents or businesses) in the area with closed circuit security cameras, doorbell video cameras, or dash cameras are asked to review their footage for suspicious activity or a similar suspect vehicle for the period between 7:00pm and 8:45pm on July 13, 2023.

The July 13, 2023, Niagara on the Lake fail to remain collision investigation by the Niagara Regional Police Service (NRPS) Collision Reconstruction Unit detectives remains ongoing.
The investigation has determined the collision with the victim may have occurred at approximately 7:50pm. The 84-year-old male cyclist / victim from Niagara on the Lake remains in hospital in serious but stable condition.
On July 19, 2023, detectives located and seized the involved pewter coloured 1999 GMC Sierra pick up truck in Niagara Falls. The truck will undergo an examination by detectives from the NRPS Forensic Service Unit. Detectives noted that the damaged areas had recently undergone repair. Previously owned (used) GMC auto parts had been used during the repairs including a grill, passenger side head lights and, and a passenger side towing sideview mirror.
The investigation has also determined that after striking the victim the pewter coloured 1999 GMC Sierra pick up truck fled the area turning onto Concession 2 Road (southbound). The GMC then travelled to York Road where it turned west into St. David’s. Once in St. David’s the GMC turned southbound onto Four Mile Creek Road and headed into the City of Niagara Falls.
The driver has not been identified. No arrests have been made.

Auto part recycling businesses or wreck yards in the Niagara area report any recent suspicious sales of used GMC auto parts since July 13, 2023. Auto body repair businesses in the Niagara report repairs to a pewter coloured 1999 GMC pick up truck since July 13, 2023. Anyone (residents or businesses) along the route of the GMC with closed circuit security cameras, doorbell video cameras, or dash cameras are asked to review their footage for the pewter colored 1999 GMC Sierra pick up truck for the period between 7:30pm and 8:30pm on July 13, 2023. The person responsible should contact legal counsel and arrange for a safe and peaceful surrender.

On July 25, 2023, Nestor Chemerika, the 84-year male victim from Niagara on the Lake tragically died in hospital from the injuries sustained from being struck while cycling. His identity is being released with the permission of his family. The family requests their privacy during this very difficult time.
