On June 14, 2023, at 9:49pm 2 District (Niagara Falls / Niagara on the Lake) uniform officers from the Niagara Regional Police Service (NRPS) responded to a report of a serious motor vehicle collision in Niagara Falls.
Officers and emergency personnel from Niagara Emergency Medical Services and Niagara Falls Fire Service attended the scene at the intersection of Lundy’s Lane and Highland Avenue. Paramedics treated the driver of a blue Hyundai Sonata for serious injuries. The driver, a 33-year-old man from Niagara Falls was transported to a local hospital.
The initial investigation determined that a grey Dodge Durango had failed to stop at a traffic signal and struck the Hyundai at a high rate of speed. The impact caused both vehicles to roll. The Dodge came to a rest after contacting a near by building. The Hyundai, after being hit rolled and knocked down a traffic signal pole.
The driver of the Dodge initially claimed to have been a passenger and that the driver had fled. Officers on scene were able to consult with NRPS personnel in the Real Time Operation Centre (RTOC) who could confirm who the driver was. In speaking with the witnesses and the driver of the Dodge, officers formed grounds that he was impaired. Derek Joseph Horth (31 years) of Iles Des Chenes, Manitoba was arrested and charged with the Criminal Code offences of:
Impaired Operation of a Conveyance by Alcohol Cause Bodily Harm Impaired Operation of a Conveyance Blood Alcohol Exceed Legal Limit
Horth was held in custody for a video bail hearing to the Robert S. K. Welch Courthouse in St. Catharines on June 15, 2023.
Both vehicles sustained considerable damage. Damage is estimated at:
Dodge – $50,000 Hyundai – $30,000
Roads in the area were closed during the investigation and re-opened at approximately 2:10am.
