NRPS member arrested following investigation in Niagara on the Lake

On August 5, 2024, the Niagara Regional Police Service (NRPS) became aware of allegations involving a Uniform Constable employed with the NRPS, following a call for service at a home in the Town of Niagara-on-the-Lake.

In responding to the call for service, it was determined that an on-duty member of the NRPS had been involved in an altercation with a suspect.

As a result, the NRPS requested Hamilton Police Service to investigate the incident to eliminate any potential conflict of interest.

On Tuesday November 26, 2024, Constable Ben Tomiuck was arrested and charged with the following offences:

1 count of Assault, contrary to section 266 of the Criminal Code

Tomiuck was released from custody on a Form 10 Undertaking, scheduled to attend court on January 2, 2025, at the John Sopinka Courthouse located at 45 Main Street East in the City of Hamilton.

Tomiuck has been a police officer with the NRPS for 23 years and was assigned to general patrol in 2 District (Niagara Falls/Niagara-on-the-Lake) at the time of the alleged offence.

In accordance with the provisions of the Community Safety and Policing Act (CSPA), Tomiuck has been suspended with pay.
